I work for the public sector and am lucky to be getting my salary paid in full.
however, my school want me to claim for loss of earning and give the money to them to claw back some of my earnings.
im reading the law on this differently and i think that may be illegal!
can anyone help?

Are you in England?
You can only claim loss of earnings if you've lost earnings. If they are paying you in full there's nothing to claim.

They say this is the process they have followed with many employees over the years. We are paid in full and then claim from the court and give it to them.
its stressing me out because I don’t want to get in trouble from work for not doing it or the court for doing it

They might mean that you claim the loss of earnings from court which is about £65 and then they top up the rest to your usual salary. Some employers do this.

That would make more sense but they just pay us in full as normal. Then employees claim for loss of earnings and pay it to the school.
that isn’t topping up?

I’ve got mixed messages. Court clerk said I can’t do this and work are saying they are wrong we always do it!

I work for the local authority- we are paid in full for the duration and told we must do it as it's our 'civic duty'. No claiming for lost earnings only the travel/meals. There was no question at all about claiming for lost earnings - I find this really strange if you work for a school. As I understood it was for people who actually didn't get paid from work whilst there. There was one poor woman in my group who was expected to work remotely in every 'free minute' - I could not have done that!

When i did jury service, i had to claim the full amount for lost earnings from the court and my workplace then deducted that amount form my usual earnings. So i still got paid in full and wasn't "making Money" by doing jury service. Effectively your school are doing it the other way around, paying you in full and then asking you to give them the 'extra'money.

There is a difference between public sector and private sector employers.

Essentially for public sector employees it’s an administrative time saver as ultimately the public purse pays either way.
