Car accident, first Time, will I win?

Helloo,

my DH has been supportive but I feel abit worried and and scared the other driver might lie…I’m not always so trusting.

my DH said I said should have asked the other man to write down or record him say he was at fault but I didn’t as I couldn’t process it all.

it was a small accident, I was in the middle lane, and the other driver was in the right lane. We were approaching a roundabout, and I was focusing on my lane which was abit clear and I was going straight.
the right lane had some traffic.

Next thing I know there is a great big thud.
A car in the right lane turned into my lane and hit my driver side rear wheel area/ passenger door area and a little bit of the rear bumper. It’s is all scuffed up and dented 😭

there was traffic in his lane and I think he was trying to avoid it and drove straight into my car.

He told me he didn’t see me.

I told the insurance company but they have called me yet.

I’m worried that he might lie and I don’t know how to fix the car. My DH says the insurance company will recommend a garage.

I’m just worried the other person will lie, but I sent pictures.
there were witnesses but it was busy rush hour and everyone just drove off without getting any peoples details.
I got the driver’s name, phone number, car reg.

My car does drive, and I am fine. I have full comprehensive insurance.

Did you take pictures of the position of the cars with the lanes clearly visible?

ask on your local social media pages if anyone witnessed the accident in the hope that someone comes forward.

Even if they lied realistically your car hasn’t moved from the lane you were in…. They’ve driven into you. The damage to both vehicles will be consistent with this!
Say even if they said you were at fault they don’t not fix your car!! It’s still fixed….. yes your premium will go up slightly. But don’t panic, no one is hurt or injured , cars can be fixed - it will be okay

It is not about "winning" or "losing" and it's not your job to get the other driver to admit who is at fault. You explain your version of events to the insurance company, the other driver will explain theirs, the insurance will decide who is liable, him claiming he didn't see you is a pretty clear indication that he probably is.

I don't see how you could be at fault. How could your driving have caused that accident?

You definitely need to follow your insurers instructions - make sure you speak with them today. Say that he admitted the fault.

I tapped a neighbours car side panel at negligible speed reversing very slowly one night and it was £4500 to fix. You will be making a large claim and he will be liable.

You also need checked out in the future for injury. I had someone go in the back of me and I was totally against a personal injury claim although my insurers insisted I be checked out. At this point we realised I couldn't move my right shoulder properly at all and all the weird headaches started making sense. Whiplash takes time to show up and years later that shoulder is still troublesome.

He may lie, yes - it happens. He may, for example, say that you moved into his lane. If that happens and you don’t have dashcam footage or a witness statement to the contrary the insurance company will go ‘knock for knock’ - which essentially means your respective insurance companies arrange for your cars to be repaired and you each pay your own excess. It’s bloody infuriating and unfortunately it happens all the time. We’ve had this twice and the insurance companies really aren’t interested in forensic examinations of cars following minor incidents when there’s no serious injury or death.

My advice is always get a witness statement whenever you possibly can and install dashcams back and front.

Unless you were drifting the wrong way around a roundabout, how could that part of your car have hit his?

Someone reversed into me in a car park. My rear dashcam clearly shows that I was stationary so my insurers are pursuing the third party. I have them in all of my cars because other people are basically twats.

@2chocolateoranges Noo we moved the cars out the way to not block the road, but I did take pictures of the damage. Was this the wrong thing to do?

@Misthios Oh okay, I did not know this was the process. Yes he did say he did not see me, but he drove into the back side of me.

@SirChenjins I hope there isn't any lying :( Funnily enough my DH was talking about getting the dashcams put in for a few months.

@FunZebra oh no, I wasn't even on the roundabout, he turned into me in the straight lanes approaching the roundabout. I was literally going in a straight line on the straight road. Yes my DH has told me he will get the dashcams now!
