Wrong bank named on title deeds, can anyone advise.

We have been home owners for 25 years plus and this is the first time we have encountered this.

Offer has been received and we accepted, last action to register the title deed with new provider!

Our new solicitor noticed the title deed stated the mortgage was with NatWest bank when it supposed to be with Alldermore.

Went to old solicitors who tried to blame us suggesting we used another illustration offer🤬 proved evidence to them (via their own app) they sent us the wrong title deed forms to complete.

it’s been 3 weeks and we are no further forward, Our new solicitors have advised there hands are tied as they can’t move forward until title deeds are in the correct bank.

Can anyone offer advice, we are chasing everyday , our broker and solicitor are chasing everyday but old solicitor unable to give time scales other than to advise they are trying to resolve it asap 🤬

Yes sorry remortgage, our fixed payment plan expired last month and we are now on a variable rate, although affordable not ideal.

It’s a remortgage that has been registered in the wrong bank lenders name…

im not sure if that’s the case for all areas however our new lender gave a 25 day turn around.

We have remortgaged a few times over the years none has taken months to complete, normally complete within 4/8 weeks .

We do and will be going down this route if we can’t get a satisfactory time frame, husband is suggesting we give them another 2 weeks then going through our home if we can’t reach a resolution.

we've never been in this situation and when we’ve looked online there is little information.

Apologies just for clarity, we remortgage in 2022 with Alldermore on a fixed rate for 2 years.

This mortgage was due to expire , so looked about in March for new mortgage deals and found a deal with liked, offer was accepted in April and was supposed to be completed mid May……

This is when our new solicitor noticed that Alldermore solicitors had put the wrong bank on the title deeds….

It sounds probable that LR may have messed up and it wasn't picked up at the time.

Have you asked your solicitor what they are actually doing to resolve? Are they in dialogue with LR and ask them for their next steps to resolution.

It's quite an unusual situation. They're going to have to find the paperwork from the original conveyance in archives. Unless you have a copy of your file from back then? I know I have mine from all my properties, but then I'm a bit of a pedant.

Presumably the original lender wasn't taken over?

@PrincessofWells , like you we have kept everything, we have all paperwork that shows and proves old solicitor are at fault, they just keep saying they are trying to resolve it with NatWest and have not mentioned LR once.

I'm assuming (hopefully) that they are trying to resolve it through NatWest and that included the land registry.

As for our new solicitors they say their hands are tied until the old solicitors rectify the title deeds.

I agree with @PrincessofWells , it’s the Land Registry’s fault. I’m surprised Aldermore didn’t chase your conveyancer for evidence that their Charge was registered.

I imagine it might take a while to sort out as NatWest will need to check that you really don't owe them any money but, once they have done so, they should be able to sign a Deed of Release which will lift their charge. In the meantime, I would have thought that the solicitors will go ahead and register the mortgage in favour of Aldermore.

Yes we did, HOWEVER that was the form old (alldermore) solicitor sent us….

Our mortgage advisor questioned it at the time… and solicitor aid from Alldermore advised it was an offset account from NatWest.

My husband re questioned this at the time on the app we used and again it was confirmed by another solicitor aid that it was an offset account.

We then received paperwork that our mortgage is with Alldermore.

We have everything to prove Alldemore/ there solicitors are at fault, we have everything on emails/app/postal letters etc… and we’ve also printed out everything with their own pdf reference numbers etc…

We just don’t know what happens now, we are 3 weeks from the findings and nothing is moving forward, hence asking here what our next steps should be.

We do have legal home insurance
however hoping it does not come to this.

Alldermore has sent us a “new” mortgage deed that we should have orginally signed in 2022 , we done this 3 weeks ago.

I’m wondering if we can request to be re-compensated from Alldermore due to us being out of pocket?

We are out of pocket as we are now on a variable rate which is costing us £XXX pcm more than our fixed rate mortgage.

IF it wasn’t Alldermore mistake we would not be on their variable rate as we would be with our new mortgage provider paying £XXX less a month.

Until this is resolved, we will be paying £XXX additionally each month.

We choose Alldermore to remortgage with, they used old solicitors who we had no option to use, our contract is with Alldermore and not with the solicitors they appointed to handle the legal side of the mortgage loan.
