Am I entitled to cms

This a bit of a difficult one, 7 years ago I split from my ex wife, due to false allegations of domestic violence , domestic violence from her and abuse of our children. shortly after our children were taken into care due to the abuse. And my parents ended up with the children, they didn't end up going to me because of the domestic violence claims from her, my depression from the abuse and false allegations and knowing my children were living with an abuser. She also accused me of rape and numerous other things after the proceedings started to make sure the children wouldn't live with me. Since she was found to be lying at the end of the family court proceedings nothing ever came of the rape allegations, but under advisement from social services they said I should remove myself from the court order to have the kids live with me as it could take alot longer to go through court. Over the past 7 years I've had social services say they have no worrys about me with the children and my contact has increased and increased to me having them at least 3 nights a week and usually in school holidays I get them for 100% of the time. She only has supervised visitation once every 2 months that she rarely turns up for. I was just wondering could me or my parents apply for cms

The person who is the main carer for the child is the person who should apply for child maintenance. From what you describe, I would guess that your parents would be the main carers and so they can apply for CMS.

You can apply if you’re:

  • either parent (you do not need to live with the child)
  • a grandparent with main day-to-day care of the child
  • the child’s guardian
  • a child over 12 living in Scotland
