careless and inconsiderate driving contravening a solid white line

Hi all,

My DH has received a notice of intended prosecution for this. He says he did it. He's an idiot and I completely do not approve of his driving, he is now (rightly) regretting his behaviour and is devastated he was so stupid.

My question is what is the likely punishment for this? He works in the trade so his car is his only method of being able to work with all his tools etc.

I'm absolutely terrified he will loose his licensee. We have 2 children under 3 and he is the main breadwinner. We will loose our home if he cannot work and I can't think of anything else because of the anxiety of what will happen to us all.

Again I agree he was completely stupid I'm just hoping to get some real opinions on what will happen to him.

He has no previous convictions or points for anything.

If he's received an NIP, does he need to return it with his details etc or is it actually a court summons?

He has returned the form giving his details, no court summons yet.

Do you know if we're unable to pay the fine what will happen? Will he be given the option of a small monthly payment?

Fines are set on income. It'll be proportionate and he'll be able to ask for a payment plan.

If he accepts the fixed penalty, 3 points and a £100 fine. However, he may be offered training as an alternative under the National Driver Offender Retraining Scheme. That will cost more than the fine, but he won't have any points on his licence.

Fines are only set on income if they are imposed by the courts. This is likely to be a fixed penalty, which is £100.
