University Support & Financial Settlement

Name-changed as my ExH has previously read my posts on here.

My ExH and I are divorced but don't have a financial settlement yet (I know I need to get this sorted, but it's complicated ...).

My Children - including DD 17 - live more with him than with me so it is his income which is taken into account for University support. According to forms DD has seen, he earns over £62k but he has told her he won't give her the additional support that the system assumes he will. I am on £26k and, though obviously paying CMS, can't afford to meet all my own financial obligations.

Can I get this sorted as part of my financial settlement so he has to do it?

Not making a comment on the morality of a man on £60k+ not supporting his DD at Uni just general thoughts.

Is she due to start Uni this autumn?

I don't think she will be alone at Uni in having parents who, for whatever reason, are not paying their whack. I'd suggest making contact with the Uni's student services people and seeing what advice they have.

Many students use the parent with the lowest income for their student finance application. At this age their living arrangements are often fluid, and is hard to truly say which parent they "live" with.
Parents cannot be made to support their children, there is nothing in the Student Support Regulations to compel them to pay. Therefore I cannot see how a court could make such an order when the government doesn't even expect that.
