No collection by evri so no refund from the retailer. What next.

I purchased 3 large household items from La Redoute 5 weeks ago. Evri didn’t appear on the original delivery date but I contacted them and they did deliver.

Because they are large items the only return method is to use Evri. I decided to return the items just 2 days after they were delivered.

A collection date was booked online but Evri didn’t collect.

I then agreed 2 further dates with Evri. Again they didn’t collect and after the 3rd failure they emailed me and advised me to contact the retailer (which I’d already done to complain to la Redoute).

la Redoute then made an appointment (evri didn’t come) then another date (yesterday) and again they didn’t come.

thats 5 appointments that Evri have ignored.

All of this is documented via email.

i have notified la Redoute of this latest failure and asked for assurances about my refund of £568. They have simply said that when they get the rugs back they’ll refund me, but if evri wont come what can I do??

Stupidly I paid for the items with a debit card otherwise I would be less worried as I could claim it back that way.
I don’t think a charge back request will work here.

I cant find anything online about this chain of events or if there is legislation that protects me when a courier fails to uphold their side of the bargain but I’m thinking:

my contact is with la Redoute.
they offer free returns.
their contract is with evri.
ultimately it’s their problem if evri fail to deliver.
la Redoute must refund me whether evri collect or not.

right now la Redoute are making another appointment #6 with evri.

i am very worried about my refund. Any advice?

Assuming you bought the goods online, and given that La Redoute are arranging collection, the law is that you must be refunded within 14 days of you telling them that you were cancelling the contract. If they had not offered to collect the goods, it would be different. They would then have 14 days from receiving the goods.

That’s interesting. I didn’t know that. Do you know which law that is - so that I can refer them to it if it comes to that?

And yes I did buy the goods online

small claims court?

That would be the nuclear option I suppose.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, specifically Regulation 34.

Did you end up keeping the furniture and getting a refund? I'm having the same problem with Evri, funnily enough with a La Redoute order too. I still have some time before my 21 days is up to return though!
