Should I pursue this?

I got made redundant as a manager in a store that has a lot of stores throughout the UK. They said they were permanently closing the store. I took redundancy and moved on. Its been 5 months and they are readvertising my role and reopening the store. Should I seek legal advice, would I have a leg to stand on? I got a good redundancy payout.

It used to be law that your job couldn’t be given to someone else within 6 months. According to ACAS if you have a grievance, you need to make a claim within 3 months. You could contact ACAS, they are the people to ask.

Why would you want to?

would you want the job back?

No but I feel like it's unfair dismissal my contract was an older one, one that they don't offer any more it seems illegal

It has never been the law that you can't give a job to someone else within 6 months after making the previous job holder redundant. It is a good general guide that you should only make someone redundant if you cannot see the situation changing for at least 6 months, but that is not the same as the law prohibiting recruitment.

It is unlikely that you have a claim. However, if you want to be sure you need to consult a lawyer who specialises in employment law, not internet randoms. If you have legal cover on your home insurance, they may be able to help.
