I signed a waiver that i didn't read before going hairdresser
However i straight away was in agony, my scalp hurt from extremely tight attached extensions

I reported it to her Thursday and she said she was busy with other clients and sounded annoyed even tho i sent her photos and videos of my scalp and how its cracking and sore
explaining i cant sleep and taking 6/8 painkillers a day

So she said can see me Tuesday, at this point i asked for second opinion and was told it's too high and will
cause bald patches if extensions won't come off immediately.

I was too scared to go back there to take them off as thought she might rip the rest of hair , got them off and now i have injuries on my scalp .

I don't think i should pay £1200 for that and at least should get a refund but she pointed out the waiver and everything i signed .

Can i do anything or not really?

I think by removing them yourself and not allowing the hairdresser to rectify you have no chance of a refund.
Were the injuries caused by the extensions or by the removal?
Do you have photos tho prove the extensions caused the injuries not the removal?

i asked for opinions of other hairdressers and they all said it's unprofessionally attached

plus she was talking to me in a rude annoyed tone so i was scared to go back and get it removed by her . I felt it's cruel of her to suggest i stay in pain for 5 days before she can remove it . Every hour seemed like ages and painkillers only was taking edge off not totally helping

It all made it impossible for me to return to her , i felt unsafe

damage is caused by her attaching it so tight

i was in pain but it says to allow few days for your scalp to settle and it will feel uncomfortable
but on day 4 i got sore patches and cracks so i was expecting she'd see me immediately not say wait another 5 days and pain was progressively worse with each day

How did you remove the beads?

I've had very tightly fitted extensions multiple times and I've never seen this reaction before (I've either experienced my hair being pulled out and/or sore bumps). Could you have been allergic to the beads coating?

removed on different salon

it's not allergy , it's extremely tight attachment and being left for hair to be slowly pulled out unattended

i got it removed yesterday and got email with other hairdressers opinion

Shall i just leave it then? and move on since i signed waiver and fighting it will lead nowhere and cause more upset ?
i am already depressed as it is about whole situation

She told me that she is 29 weeks pregnant and doctor told her not to work too much as she is 54 so i don't want to cause her stress either with complaining

Can you ask her for a copy of the waiver? I've never ever signed a waiver at a hairdressers, I had no idea that was a thing, but you'll know more when you know what you've signed x

Yes so it's basically says that under no circumstances i can ask for a refund .

But i sent video and loads of professionals review it and also the hairdresser i saw yesterday to take it off , they all say she injured my scalp by applying it all wrong amd tight and that it's cruel to leave me in pain for 5 days .

So if i cant ask for a refund can i take her court i wonder?
. Cause in waiver doesn't say i cant sue her . Just that there will be no refund under any circumstances

And unrelated but her excuse was she is 29 weeks pregnant and can't see me after clients as needs to work less . But it's a lie she is not pregnant , just found through FB . I was thinking that it would be dangerous to work if you are 54 and pregnant, as it's high risk and didn't want to upset her with my complaints , so i guess that's why she invented that

Also i asked if she had insurance and she is avoiding the question just sends me back what i signed . I'm depressed , asked GP for anti depressants they said to come in few weeks again if i still feel down. Couldn't work or do anything for a week now am avoiding leaving house and looking at wigs or toppers as feel self conscious :(

I'm fairly sure that a waiver form doesn't trump legal rights (in the same way that an employment contract or letting agreement doesn't overrule the law re employment or tenancy). Would deffo be worth some research. Though unless you have costs arriving from the pain (ie unable to work etc) you won't be able to claim any more than the costs of the install and removal.

You can't sign all your rights away, regardless of whatever waiver they had. The hairdresser can't exclude liability for injury caused by negligence.

However, I'm no hair expert so I'm not in a position to comment on what's happened here and whether it would count as negligence. I'm not saying I don't believe you - just this isn't something I know anything about so I don't want to give you the wrong advice.

thank you for opinion . I called citizens advise today and they told me to write a letter of complaint and send it sign for so she can't say she didn't receive it .
Giving her 14 days to respond whether she agrees to refund and if not then i can take matter further

on government website says her business was dissolved in November 2023 so im confused how she is still working
I'm not clued up with legal stuff so maybe it's allowed .

I know it's just hair but i feel devastated and even a refund is the least she can do . She is reporting my reviews lying that immediate appointment was offered even though i have all correspondence in texts . So im not even allowed to to warn anyone and post honest review

I'm dreading getting her reply as everything she said so far just made me feel
more depressed.
I will think perhaps best to cut my loses as going through court and listening to her banging on about waiver and judge possibly siding with her will add to distress i'm already experiencing

Send it recorded delivery. Draft with CAB. A waiver does not include poor incompetency that injuries you. A legal waiver does not trump legal rights to getting what you paid for pain free and injury free. So she is trying it on - refund and compensation is the minimum she needs to pay

oh and she has a review from her her husband talking like she doesn't know him !
makes me think most reviews are fake . And when i had the extensions on front looked like that surely it's not a job worth £1200 ! it looked like a slipped wig
extension unit was slowly moving backwards and now i have a bald patch at front . Offering to sort it out in 5 days is not reasonable in her side and also how can you trust someone so incompetent. She'd rip more if my hair as she was annoyed i'm texting her with complaints .

Really you need to see a solicitor but if you want to do it yourself...

Unfair Contract Terms Act... she can't exclude her liability for injury caused by negligence. Waiver means nothing.

You write a Letter of Claim. There's a template and information about what to do here www.justice.gov.uk/courts/procedure-rules/civil/protocol/prot_pic Include the photos. Send by Recorded Delivery,

Ideally you want independent evidence that the work was substandard. Would the other hairdresser put something in writing to that effect?

It's not a refund you want but compensation for your pain and suffering. And the cost of putting it right. Hard to value without proper evidence but £1200 probably isn't far off the mark.

At the same time as you send the LOC, make a written Part 36 offer of £1,200. CPR 36 tells you how to make the offer..

Take it to small claims court. She's lied and done a crap job, the cost to take it there is negligible, you can send her a letter stating that if you don't receive a refund, I'd probably aim for half, that you will file with small claims and see her there
