Will he be charged

I've posted this in chat as well.

grandson 18 was driving with 3 mates.
He was driving down an unfamiliar road.
Came down a hill and there is a very sharp bend with a stop junction.
The sign to give way is behind the corner and a lamppost.
No other car was involved. His car went into a wall.
At the scene he was arrested as the lads in the back were hurt.
Released without charge or bail. Waiting for any reports to come back.
One badly bruised, the other had a couple of broken ribs.
DGS was tested for drink and drugs both negative.
(Waited 4 months for the results of drugs)
Police have confirmed he wasn't speeding.
No problem with his car.
Insurance company are saying they class it as an accident.
They agree the stop and give way sign are in the wrong place.
The police officer is going to discuss the case with his chief officer
which could take a few days.
In this situation does anyone know whether he will get a caution, fine, points or what.

@ticktickticktickBOOM not what i asked though is it ? Any action like going over the limit or maybe misjudging pulling out can cause an accident it only takes a moments lapse so therefore you may have not Hit something but could of.
the op has said signs are poor and it appears to be an accident blackspot so its not so clear cut

Still nowhere near the same as driving full on into a brick wall and breaking your mates ribs. The police were called. It was hardly a beep on a motorway exit lane.

He may not get prosecuted but I wouldn’t be surprised if one of his friends sues him for the injuries. No win/no fee companies would be all over this.

i suspect not much will happen.

20 years ago my nephew was one of those passengers, instead of hitting a wall they went over a cliff. He almost died both at the site & again in hospital. He suffered a brain injury & will never live independently.

the kid driving didn't get any type of punishment, travelled, married, has a child & one on the way.

your GS, will probably not be charged as they'll say he wasn't speeding.

you.his parents need to how easily this could have ended up very very badly.

The OP isn't asking for a critique of the boy's driving ability or whether he should return to the road or hand in his driving licence as penitence.

It's unlikely he will be charged. It was an accident. Luckily he didn't kill anyone or hit a pedestrian or another car. Drivers of all ages and abilities have accidents. There but for the grace of God go most of us.

You really don't seem to understand that driving under the speed limit doesn't automatically mean driving safely. If it was a NSL road and he came round a sharp bend at 59mph that isn't speeding but isn't safe, it does sound like he was driving too fast with his mates in the car. Surely you have to be going pretty fast round a corner not to be able to stop at a junction and to smash into a wall.

As no one was badly hurt the police may decide not to pursue it but surely the actual speed he was driving would also be a factor and all you've said is that he wasn't speeding, Does his black box show the actual speed?

It's difficult to say what the outcome is likely to be without knowing what offence he was actually arrested for.

If there is enough evidence to prosecute then I suspect yes, it is quite possible he will be charged. The evidence of serious injury is there and if they can prove careless driving the CPS will most likely charge.

My friend's husband is a chauffeur, has an impeccable driving record, been driving for 37 years without an accident. For his job he had to take an advanced driving course and had to retake the IAM advanced driving test every three years.

He had an accident on a motorway slip road coming up to a roundabout. It was an accident caused by a momentary lapse of concentration but because the other driver had a broken bone he was charged. Court appearance, 12 month driving ban and a massive fine. He sadly lost his job. (But has since found another job which is better hours and no weekend work so 'every cloud')

It is impossible to know the likely outcome from the information given. Those claiming otherwise are guessing. At least one poster is making up "facts" to suit their prejudices.

He drove into a wall?! Sorry I cannot see any scenario where driving into a wall without other vehicles involved is anyone’s fault but his.
