Cannabis use in custody proceedings

My partners ex is a habitual cannabis user smoking 3/4 times a week throughout the whole length of their relationship. Totally denies having ever smoked, nearest thing to an admission was wouldn’t smoke around child. Never really had much cause for worry really but recently there have been a few incidents which have caused concern relating to neglect(not going to go into the specifics here) CAFCAS officer talked about drug testing and asked if my partner was willing to pay for this testing. Also said courts tend not to be bothered at all about drug use unless really severe issues or abuse. Concerns shared around impact that use is potentially having on child. Just wondered really if anyone has been through the process of custody arrangements with an ex who uses cannabis and/or experience of drug testing, how does it work? What happens if they refuse testing?
To provide a little context other parent doesn’t work, ours is working household where we don’t smoke either cigarettes or drugs.

So from what I'm getting from your OP is that the ex is the RP and you are attempting to get custody and that due to your partners accusation that the ex is a habitual cannabis user they are requesting that your partner pays for testing?

A parent cannot be forced to take a drug test. If the court requests a drug test and the parent concerned refuses, the court will look at all the evidence including the reasons behind refusal. The court can draw a negative inference from the refusal to take a test, but they don't have to do so. Whether they will depends on the evidence.
