House insurance legal cover

I made a purchase covered by a warranty. During the warranty period, i reported a fault that was not repaired. The problem was intermittent and didn't affect use so i didnt chase it up. I am now outwith the warranty and the fault is now causing further damage that i could nit have forseen. I have had a quote for repair and had it confirmed that there was a fault in how the item was fitted. The seller isnt interested as outwith the warranty.

I have legal cover with home insurance and attempted to make a claim as legal advise says i could have a breach of contract claim. Insurer has replied to say i am not covered as the original report of the fault (via email) pre dates my insurance policy. Can i claim on an old and now expired insurance policy with a previous provider which covers these dates?

Are you in Scotland? Not sure if the law is different there (as it seems to be for everything else) but you've used the word "outwith" and I've only ever heard that from the Scots. ☺️

I woke in insurance.
You need to claim one the insurance which was active at the time of the incident - it doesn't matter if this policy has since been cancelled.
