Does anyone please please remember my thread about teenager daughter and a car accident?

As above, is there anyone who remember my thread from last Oct about my 18 year old daughter who had a car crash?
In a nutshell, she collided with another car. They were both at fault. No dash cams. No witnesses. My daughter's car ended up being written off. The other persons car needed £2000 of repairs.
The other person wanted to settle the claim herself and wanted my daughter to pay her £600 for a garage repair. She'd only gone to one garage and refused to get other quotes. She didn't want to involve the insurance.
The kind people of Mumsnet advised me and we claimed though the insurance, as did she.
We've just received a letter from the county court, which I think means she's suing my daughter for over £2000.
She's written a statement in which she fully blames my daughter. This is untrue. What on earth do we do?
Please any help or advise would be so appreciated.

Well she's not had a settled claim but estimated the costs (her one and only quote) at £600.. that's a huge difference to over £2000 that it actually cost her. I'm guessing she's had the work done and paid out of her pocket and wants Dd to pay her back rather than using her insurance (for whatever reason). Even to add in her £500 excess that she will have chosen and agreed to. Cheeky mare.

I don’t know about the legal side of this op, but simple common sense tells you she’s trying on. Definitely don’t panic about it

Your dd has been paid out. Nothing will happen to her. Last June a twat hit me head on round a country lane bend. Him on the wrong side of the road despite a pull in on his side... My insurers are taking him to court as him and his insurance company have ignored all correspondence from my insurance company. I see him 5 days a week and he still drives like a knob.

My car was a complete right off. His truck unscathed.

Thanks. I had to fill out a form for court. It had the option to claim my excess off him so I ticked it!! Will enjoy spending that!

Years ago I was rear ended by a woman in a massive 4x4. She no word of a lie, had 4 kids and 2 dogs all loose in the car. She was on the phone and dealing with the loose menagerie when she hit me. She was adamant she didn’t want to go through the insurance and said her husband would pay whatever to put it right. Unfortunately for her, I was in a works car so had to report it. Thought nothing more of it until a year later when work contacted me (I’d since left) saying she was taking me to court for stress and trauma to her children 😂

Oh God. I hope nothing came of it. It's just stress isn't it. Stress that's really not needed atm!

I had a couple of letters, had to write a statement and send the pictures I took, but that was it. Never heard again!

Dealing with idiots like this on your behalf is part of what all our insurance premiums pay for. Your daughter should try to take a step back and remember that none of this is her problem or her responsibility. She has fully comprehensive insurance so that other people can have jobs sorting out messes like this. Let the good people at the insurance company do their jobs. Refer all correspondence to them.

So, I just want to quickly update ...

We've had another letter today. The same as the other one (from the county court). It's almost identical, bar a few key things.

The solicitor dealing with it has changed from a trainee solicitor to a trainee solicitor apprentice.
The amount of interest has risen.
DDs name has been written differently (both times it's been wrong).
The other party has also changed her statement to actually blaming DD for the accident. I can go into more detail if anyone can help on that point.
So, two letters the same, but slightly different.
We've also seen that the letters state that the other party has already had her insurance pay out.
So she's been paid by her insurance. But is claiming money from my DD to cover the loss in value of her vehicle.
The loss in value is the £2500 ish pounds. Then there's her excess plus interest.
I am so lost. I thought she'd not had a pay out. But she has. So she's not out of pocket is she? (Premiums going up excepted).
I'm so worried that DD will have to pay out herself. She has nothing of worth except her car and her MacBook for uni. Her MacBook is on HP from Apple. Her car is a 16 ford KA. What on earth do we do from here?

Also to add, me and DH have nothing particular of value. We'd not be able to raise this almost £4000. Dd is adamant that the other party is a much to blame as she is. Dd insurance company said it was a 50/50. Yet the other party has written an untrue statement and signed it.
Ffs. What a bloody mess.

Are these actual court claim(s) or just letters?

Either way, the advice remains for your DD to pass onto her insurance company to deal with.

It called a money claims case. DD is named as a respondent on it. It's a HM courts and tribunals letter. Has an official crest on etc.

We're just worrying that she's being sued personally and it won't be settled by her insurers. I don't understand why she would be claiming for her money back when she's already had it so to speak.

Being left out of pocket (she'd couldn't have claimed on the insurance if she didn't have insurance) she has now contacted some ambulance chasing no win no fee law firm which operates on the basis of sending threatening legal letters in the hope that this panics / scares you and your DD to settle out of court.

In any event the best advice is as per all the other posters to refer it to your insurance company.

Got so many ambulance chasers calling me after I had a minor knock. Who lets these opportunists know my details? Pretty sure it is one of the insurance companies. They get your number then try to muscle in with an extra claim for credit hire or extra injuries. Ignore, refer to your own insurance company. They literally grey wall them until they disappear.

Well that was my first thought but her statement claims ..

"As a result of the accident the claimants vehicle was damaged and in need of repair...
These repairs were paid by the claimants insurance in the sum of £2653. This is no more than it would have cost the claimant had the arranged the repairs themselves..
This sum reflects the amount the claimant seeks to recover as a measure of the reduction in value resulting from the damage caused to the vehicle".

So it states that her insurance has paid out. She's also claiming her voluntary excess (£500) plus interest PLUS court fees. I'm so lost.

I really would recommend getting this moved to the legal board, @LongTallSuzie. There are brilliant posters who know all about the money claims and small claims path (and the various shysters who try it on, plus their methods).
