What are the chances of ex being granted joint residency?

Hi, really hoping someone has some experience in this can advise me .
I was threatened by my dd dad and his mum with a solicitor because I stopped 50/50 contact and changed it to every other weekend due to his smoking habits and being high around my dd
they said they weren’t seeing dd until this was sorted so they stopped contact . I went to a solicitor and she’s advised me to stop the contact so she wrote them a letter stating this. Dd dad then contacts me saying he’ll agree to what I originally offered (a week later!) which then I said no as I had concerns and my solicitor will be in contact
anyway my solicitor rang me today to say his solicitor sent her a letter and saying he doesn’t agree to me getting a residency order , wants joint residency and his solicitor doesn’t think there’s any reason why I stopped contact and that it’s “out of badness” because we broke up ..
my solicitor is now putting in application for a residential order. What are the chances of the court granting me this? Or will they grant shared custody? She’s 4 and a half months old now

You need to clearly show the judge why it would not be in your child's interests for him to have 50/50 custody due to his behaviour being a risk to them. At the end of the day it's their decision. As the child is so young and he is not currently having contact it may go more in your favour as things are currently stable as they are. You could argue for supervised contact until he proves he can be more responsible.
