Stepping down as Executor

Can anyone advise the process to step down as Executor? I have completed probate and have the certificate and have marketed the property which is in process of being sold.

I am finding dealing with the beneficiaries very frustrating, they will not contact me personally only over whats app and the messages are increasingly abusive making me feel ill. I am trying to sell the property and it has issues and I don't envisage a quick process.

This wouldn't bother me really but dealing with family members is making the situation impossible to deal with professionally.

There is one family member named on the will if I should not want to continue, but would this just be a matter of passing all info to them or should the probate office be advised too?

I believe you can't step down once you've "intermeddled " without a court order. Could you appoint a solicitor?

Thanks, i thought that was the case. I will see what I can find out about appointing a solicitor if needs be.

@Nitgel what are they saying when they are being abusive towards you?

Nitgel · 08/03/2024 11:31

i don't want to go into details, but enough to make me want to seriously consider not carrying on with the job.

Can you simply pass the property direct to the beneficiaries and leave them to sort out selling it?

Nitgel · 08/03/2024 11:55

i didn't think it was that simple titchy

Unless the will specifically states the property to be sold, or it needs to be sold to pay other beneficiaries/ inheritance tax. I don't see why you couldn't just transfer it? Ask your solicitor!
