anyone available for a 10am hearing tomorrow? I applied for case to be adjourned which didn't get granted. I need to have a Tomlin Order set aside which is A MISSION

I have a court hearing tomorrow, my case is one where I am trying to prove a Tomlin Order I signed was does so under duress, the duress from the father of my children. it is to do with being a joint director of a company.

I applied to have the court hearing adjourned by the District Judge has said tomorrows hearing will go ahead. Of course I will be there but I have no legal representation and to say my world has now come crashing down is an understatement. I have written a lengthy witness statement, but it's not complete and has evidence but again not enough focus on financial mismanagement of accounts and too much focus on being the victim In an abusive relationship. I never wanted to be the director of this company that went into liquidation and now I am liable for director debts of the other director .. the other director walks away scot free. I am at a loss. Anyone available tomorrow for a 10am hearing in at the County Court to help me?

Not a lawyer. A “Tomlin Order a form of consent order. Did you have seperate legal advice when you a signed this off?

To prove duress you need to focus on physical /financial/ psychological threats that were made to you cause you to feel forced in to signing the Tomlin agreement. So your focus on domestic abuse in your statement is the correct approach.

You need to explain to the court how you felt forced into signing.

This will not get you off the hook for company debts per se. That is another matter also to be argued, at a separate hearing unless the court has agreed to hear that too but my knowledge on that is nil.

You are unlikely to find a solicitor now.
