Anyone sued nhs?

Hey all, anyone sued the nhs? Im in the process of doing so after my mom passed away in january 2023 from stage 4 cancer which could of been treated and potentially saved her life.
It came to light in 2019 that my mom had a mass in her throat after having a ct scan following a previous battle with cancer, a biopsy was done and they found a pre cancerous tumour but didnt tell my mom, after this finding they should of had follow up appointmements every month because of the risk but instead she was wrongfully discharged without knowing a thing. Fast foward to september 2022 my mom started having problems with swallowing (choking on everything she ate and drank) breathing and turning blue around the lips, dispite having a number of hospital and doctors visits no one picked up on the large tumour blocking her airways until 6/7 appointments after they just fobbed her off with inhalers and antibiotics even after begging for them to check her properly and getting second opinions on 2 occasions. She was finally diagnosed with stage 4 cancer and her only option at this point was to have a operation to remove the tumour and was informed it was likely it wouldnt go well because her weight had plumeted to 6 stone as she couldnt eat without the fear of choking or suffocating in her sleep as the tumour would prevent her from breathing properly. My mom opted for the op anyway as she didnt want to leave so soon and after fighting cancer and beating it once she was determined to try and beat it again but unfortunately her body was too weak and she had a heart attack. They managed to revive her after fitting a tracky under the tumour to help her breath as the tumour had got that big it compleatly blocked her airway,which was just going to prolong her life that little longer. In january 2023 she sadly passed away. When speaking to my moms consultant he informed me he found in her notes of the findings back in 2019 and could of potentially found this cancer sooner and she could of had chemo and radiotherapy which she would of had 90% chance of a 5 year survival or more. Anyway after contacting a solisitor they found several errors in her medical record as to which they failed my mom by wrongly diagnosing, discharging early, no treatement provided and so on.
Our case has got to the stage now the evidence is all being forwarded to nhs and courts,
How long had everyones cases took?
Was it a positive outcome?
Do i try and settle out of court if they admit wrong doings?
Im not doing this for money as anything we may get will be donated to my moms favorite charity in her memory, i just want to hopefully prevent this from happening to anyone else and a bit of justice for my mom. 🩷🩷

Good luck with your case.
When the death of my sister was investigated all that was said was "lessons will be learned". Her parents were fobbed off despite masses of evidence.

My relative did. She was in hospital and was supposed to be accompanied all the time. She was left alone and fell from the bed and broke her leg. She got £15000.

I’m so sorry this has happened to your mum. It must be so heartbreaking for you. I sued my GP after he gave me medication I was allergic to and which was clearly marked on my notes. It took 3 years for the case to be resolved and I only got a small amount as I had no permanent effects.

You seem to have a strong case so it’s worth going ahead. Expect it to take a long time though. Your solicitor will advise you whether to accept an out of course settlement. Going to court is a lottery so sometimes it’s better to take a reasonable offer.

Was there a post mortem and an inquest after her death?
From my own experience anything to do with medical negligence/nhs is usually very long and drawn out. Your solicitor is really the only person who can give you advice on this, as they will know who is involved and how the case is progressing. The NHS staff will not speak to you while the legal case is ongoing.

My df won a case against a surgeon who put the wrong sized rod into his leg/hip. My df ended up bed bound and unable to walk. They admitted liability but I think as my db was dealing with it, he did quite a shonky job of applying for my df. He got about £4k. Df suffered a lot with his hip and had lots of infections and more surgery. He lived another 5 years in pain before passing.

So sorry to hear all your experiences, i think its shocking how many people go though medical negligence on a daily, i would do anything to have my mom back even to see my kids grow up like she wanted my youngest was only weeks old 💔 no amount of money will ever fix that but if i can prevent it from happening just to 1 more person im damn sure im going to try x

I'm so sorry this happened to your Mum. How utterly devastating and unfair and I can only imagine how you must feel. I hope the negligence case brings to light the failings. No amount of compensation will bring your Mum back but it is important that her life is valued and recognised. I hope you and your family will get some comfort once the case is settled. I can't offer any knowledge but I would say that now it is in the hands of the lawyers try to get on living your lives as it could be a long drawn out situation. We are currently in the early stages of a possible negligence case against the NHS regarding treatment my husband received. We are lucky he is still here with us but I feel strongly now that these mistakes must be accounted for. If we don't then how will things ever change. All the very best to you xxx

@mrshoho Thank you, its been a very hard year and i still cant believe shes gone and to know it could of been prevented makes it harder to cope with, so sorry your husband suffered negligence but so glad to hear hes still with you and i wish you all the best in your case xxx

My mum sued the NHS. Took a long time, 5 years from first contacting solicitors I think.
They ended up settling at the last minute out of court. They took into account her age & how many years she could possibly have left & whether she'd need to pay carers as she got older or if the problems caused by the NHS got worse. She got a substantial amount, 6 figures.

No, haven't sued but my mother received awful treatment at the hands of the NHS. It's only with enough people revealing negligence that things have any hope of improving. I fully understand that people are human and anyone can make a mistake but in our case it was mistreatment, pure and simple. Your case seems negligent. One thing I can say is that it will be a long haul.

No, we have had elderly family members who had died due to nhs mistreatment. However, no amount of money could bring them back. I am sorry for your loss, but don't think suing the nhs is the right thing to do in a lot of cases.

I'm currently doing this, my DH diagnosis was missed three times but the time it was eventually found he was stage 4. He survived 19 months. If they had followed protocol at the start (and again for the two other times) it was curable by keyhole surgery. Once the paperwork goes to the NHS I think they have 4 months to reply BUT they can ask for an extension - they took 8 months with mine, I'm waiting for more reports now for the next step but each time it takes 3/4 months .... Jesus! When I worked in dentistry a few times the wrong tooth was taken out and that was a drama but this is insane!
