Victoria Plumbing - consumer rights

Hi all,

Victoria Plumbing supplied a faulty toilet - manufacturing flaw, the porcelain was too thin and the water dripped through. This was discovered as soon as it was fitted - there was no visible faults.

A video from our plumber was sent through to Victorian Plumbing, and they sent out a replacement toilet. I've asked them to cover the cost of the plumber fitting the new toilet - and I believe this is what I'm entitled to under the Consumer Rights Act.

Victorian Plumbing has been dithering about this now for three weeks. They're saying it's the manufacturer that would have to cover this cost, not them, despite the fact I purchased directly from Victorian Plumbing.

Would I be right in saying that Victorian Plumbing are obliged to cover the cost as my contract was with them? And that if they want to pursue the manufacturer for costs, that's nothing to do with me?

It's only £57 FFS!!

I agree, and would argue that the installation cost is inherent in the “replace” obligation. It’s definitely not right that the retailer would be responsible for providing the replacement but the manufacturer responsible for the installation. The law doesn’t distinguish those obligations so either the retailer is liable for both replacement and installation or nobody is responsible for installation.
