My parents bought a new build house in 1971, and the mortgage was paid off in 1980 when my father died. Mum still lives there, and it was brought to our attention recently that the house isn't on the Property Register. Mum is still in good fettle but we are all aware her time is limited. The house will be sold when she passes, will the fact the house isn't on the Register delay a sale?

(I am aware this sounds morbid and greedy, but mum also wants to know. She's a very practical woman.)

How can there have been a mortgage for an unregistered property?

Is it possible that the house is registered in the Register of Sasines rather then the Land Register?

I don't think the Land Register existed in 1971, but will explore the Sasines thing further, thank you.

You are correct.The Land Register was introduced in 1981.

It will be on the old sasines register. Still quite common here.

It will be on the old easier register, and first registration would be triggered when the house is sold. First registration does take a bit more time.

When I bought my house it was just on the sasine register and it did take longer to go through as it all had to then be transferred to the new land registry. We even had people out to measure the place. But it is what it is. If a house hasn’t been on the market for that amount of time you just have to suck it up.
