Question about wills

If I die I want to leave everything to my husband.

However, if he dies before me and I haven't had a chance to update my will before I then die, or if we die at the same time, I want to gift certain items to other people.

I'm doing my will online and can see the option to leave gifts.

But how can I make the gift contingent on my husband already being dead?

Use a solicitor or will writing service. A long time since I studied law but I believe it is very simple.

Definitely worth using a solicitor. It doesn’t cost much and also easy to update if and when needed.

My will has a number of contingencies in it dependent on various somewhat morbid outcomes linked to order of deaths and multiple deaths at one time.

I can’t recall what I paid but it wasn’t much.

Usually a clause at the beginning of the will that simply reads something like "I leave the entirety of my estate to my husband provided that he survives me by 30 days" but obviously in more legal language! Then the next clause will start with something like "if my husband does not survive me then I leave my estate as follows...."

But yes - get a solicitor to draw one up. They aren't too expensive if it's quite straightforward and you can ring around and get a quote as it's usually a fixed fee for a will rather than by the hour.

Use a solicitor. They will write it in such a way as to make sure your wishes are carried out according to circumstance.

I recommend Marlow Wills, the cheapest quote we got, very quick and efficient, done over phone interviews, a real solicitor specialising in wills (not all will writing services are by qualified solicitors) … and a MNer!
