Breakup financial agreements

Does anyone have experience or advice with creating a financial agreement? Separating from my partner and we own a house together. Trying to write an agreement to set out how the proceeds of the sale will be split (after bills, costs etc) How do I know that I'm agreeing to the correct terms and how can we get it ratified (if that's the right term) in a court?

See a solicitor. Do you have children? Debts. Pensions etc. all needs to be discussed you can't afford not to get legal advice.

Are you married? Are you and your partner in agreement as to what should happen?

TraceyLichfield · 11/02/2024 09:06

We're not married and no children together. Just the house to sort. I put in 43% compared to his 57% and we took a mortgage for the remainder of the purchase price.

You put in 43% of the deposit?

Is the house owned as joint tenants or tenants in common? How much equity is in the house?

Are you and your partner in agreement?

Did you both pay the mortgage equally?

TraceyLichfield · 12/02/2024 05:46

We're trying to reach an agreement - almost there. Last hurdle is to get ove him saying that in the event of no profit from the sale, that I should pay all of the selling costs - as I'm the one who decided to end the relationship.
It's all so painfully slow!
Might have to go mediation I guess.

If there is a possibility that there will be no profit from the sale, it sounds like there will be very little money involved. You could make your agreement legally binding, but you will have to involve solicitors to do that and there will be a cost.
