SSSC and unpaid training

Discussion came up at work and someone said that national minimum wage employees shouldn't be forced to do unpaid mandatory training outside work in order to work there. I agree. It's clear online.
However, workers on just less than 50p more than national minimum wage do have to do it and that because they are members of the Scottish Social Services Council. To be a carer you need to be registered with the SSSC and to register with SSSC, they need to do 60 hours a year training.)

So, they can't work in that job without the SSSC and can't be in the SSSC without 60 hours a year.

Who's right? Can they get away with not paying? Some workers only do a single shift a week so can't even do half an hour unpaid training a week before going under NMW.

Do the SSSC registration requirements negate the National Minimum wage laws here?

Having looked into this, it seems the SSSC requirement is 60 hours of continuous professional learning (CPL). This is not necessarily training. It can be everyday learning on the job. See "What counts as CPL" at Continuous professional learning (CPL) frequently asked questions - Scottish Social Services Council (sssc.uk.com). Employees therefore only need to go on courses if there are insufficient opportunities for learning on the job.

If the employer doesn't provide sufficient opportunities for learning on the job, there is certainly an argument that the training is compulsory and should therefore be included when calculating the employee's working hours. However, it would need a ruling from a tribunal to be sure.
