Question about wills/convent

Windysunnyday · 30/01/2024 18:48

A relative had passed away having been the member of a convent in the past. She had signed some sort of will or agreement at age (I think) 16 in England.
She recently died in her 80’s and had said to a number of family members that she wanted her money/ assets to go to the family. She hadn’t however got round to putting this in writing.
Bit random, but would anyone know if there’s any route to go down for the family?
She had signed the agreement so many years ago that the family were thinking there must be some kind of law or something that they could contest?
Thanks

If she was under 18, she was too young to make a will or enter into a contract. It is therefore likely that the document she signed has no legal effect.

However, if she was 18 it is another matter. It would then depend on exactly what she signed. If it was a will, it would remain valid unless she married. However, it is possible that her promises to her family could give a basis on which the will could be challenged.

If it was some type of agreement, it is impossible to advise without knowing what the agreement says.

I’m very grateful for this reply- I’m sure it was a will and she was 16. I will doubly check with another family member

If she was under 18 then she died intestate, i. e, without a will.

In that case assets go to her CV lose family members. Look up the rules of intestacy as strict rules will apply.

that’s very helpful, thank you. Will look up
