Yearly increment

Hi everyone, I'm looking for some advice on yearly increments at work.

In my contract it states 'you will receive an annual increment payable from the 1st December until you reach the top of your pay band.'

I started in the role in nov 20,
Had promotions in
April 2021,
May 2022,
March 2023

I've only had one increment and that was April 2022.

It's come to light that other employees who have also had promotions have always had yearly increments from their original start dates with the company and not their new roles.

I only have one contract, my promotions were variations of contracts for new title and salary, original t&c's apply.

I'm now under the impression I should have had a yearly increment in Dec 21, Dec 22, and Dec 23.
Is this correct?

Did the promotions come with a scale change? I work in the public sector and no, you wouldn't have had increments if you had a scale change. We increment on 1st April, so would have incremented April 22. A scale change at the times you were promoted would mean no increment in my sector

In my work our incremental date would change with a change of banding to the date you went onto your new band. (NHS)

If you have management responsibility speak to your HR and finance functions about this possible concern re over payments. If you don’t have management responsibilities speak to HR about your own situation.

There may be reasons why some increments don’t change depending on why their role changed or your organisational policies. I have no idea what these are so I cannot comment. But for example staff with TUPE rights can be on different contracts and be treated differently. Dates of joining can also be relevant for other things link annual leave entitlement and other rights which is why they are preserved.

That being said there could be an error. Raise it appropriately depending on your situation. Don’t use ill informed social media conclusions. Escalate to the right people.

Without seeing the full contract and the variations, it is impossible to say that for certain.

I do have management responsibilities and gave an employee advice based on my own treatment and decisions I had been given by hr.

That employee has now had back pay as was told this was incorrect (direct from hr) but they are still denying mine.

Original Contract states: you will receive an annual increment on the 1st December subject to not being at the upper limit of the band.

I've not had another contract issued with promotions, just variation of contracts that change my salary and working hours and then states all other t'c's remain

If you're on a scale salary at my place the scale receives the increment.

So if you get a promotion you'd move up a scale point and as such earn more money.

But each year the scales each increase by a %.

So you can't miss an increment as the scales are all in line.
