Neighbour dispute over shared access

Can someone please help. My neighbour has set up a home salon in their shed. They are using shared access for customers. So there are strangers are constantly walking down the side of my house and around the back of my garden to access her garden. I complained to council in March but haven’t heard anything. Surely this isn’t allowed. I don’t know if they are her customers or burglars!

I'm not sure why you're finding this so funny with all the crying laughing faces.

You say she's ignored you and not been friendly but that's a world away from proper neighbour disputes.

This could turn really nasty. It's her livelihood.

I can appreciate how frustrating this is for you however this could be resolved fairly quickly and amicably if she agrees that her customers go through her house rather than over your property.

I think you need to try and have this conversation with her in a calm manner and if she dosnt budge then gently remind her that based on the covenant her customers are not allowed and whilst you hope you can both resolve this quickly you would have to escalate this further if she persists.

And then go throttle with reporting her to every authority applicable. But at least you know you tried to resolve this in a way where you both get what you want.

@Pogonogo Yes. I know. In Cornwall planning officers are protected by a single phone number that takes all messages. You do not get to speak to a planning officer. Planning Enforcement get all their intel from the public! Well around here anyway.

At the moment the solicitor isn’t charging as they did the conveyancing on my house.
iv already put a complaint into planning in March but it’s still ongoing. Iv left messages sent emails just trying to get an update. They only take calls in the morning and it’s just impossible to get through

Iv tried having a conversation and she is just rude. She’s lied to me twice already. It’s just pointless. That’s why I’m putting it in writing

This is my home that I have paid a lot of money for. I couldn’t just stick a huge extension up without going through the correct channels. You can’t just do what you like just to earn a few quid. There are laws to abide by.

The solicitor is going through my options I believe I can also get an injunction against her. But will find out tomorrow. What she’s doing could lower the value and saleability of my house. So it’s better to sort this out now. Obviously I don’t want to spend money. But something needs to be done.

Just a word of caution - saying what she is doing could lower the value of your property - a dispute, which this is, would also need to be declared if you want to sell, making it both more difficult to sell and in order to do so, may require a substancial reduction in price.

Disputes with neighbours are not good irrespective of who is wrong and right, I would try every avenue to sort this out before going down the legal route.

There are 3 issues here: The noise from using the shared access, the excessive use of a shared access and running a business from home. Try and look at it in smaller parts, if people were using the shared access but were quiet and respectful which leads to you and your children being disturbed would that be a resolution you could accept. If the answer is yes, the 2nd and 3rd issues go away? As much as you may not want to, I would go and see your neighbour, or better still invite them into your house for a coffee, even have cake and try to come to a entente cordial. Fully explain the issues and exactly what you want to achieve.

@Bombshell2022 Never get into court action unless you have deep pockets. You are not certain to win. Disputes do have to be declared if you sell.
