Hi, just after some advice/guidance if anyone can help - Openreach want to run a cable over my property and over my garden to connect a property whose garden backs on to ours (pole that they're connecting to is in their garden).

I understand that under the Flying Wires Act they can install the cable without our permission as we don't own the space above our property but only if they don't need to access our property in order to do this. However they do need to access our garden via a locked gate in order to install the cable.

The cable will be running over a single storey garage that needs the roof replacing in the near future (under the Act the cable only has to be 2m clear of the roof), so I'm unsure about giving permission as I don't know where I'd stand in the future when we want to replace the roof and if we need to put scaffold up etc in the vicinity of the cable and the cable isn't ours, or if there's any damage to the cable and it's not our cable but is over our land to a neighbour's property.

Can anyone advise?

There is no such thing as the Flying Wires Act, although I know some Openreach employees seem to think there is. You are referring to the Communications Act 2003 Schedule 3A part 11.

There is no issue with you putting scaffolding up in the vicinity of the cable.

You are not liable for any damage to the cable unless you deliberately damage it or are negligent. If they needed access to your property to fix a damaged cable, they would need your permission.
