Stamp Duty on a discounted new build

We are in the process of purchasing a new build property. My husband works for the developer.

We are very fortunate to have been offered a substantial staff discount on the property.

The conveyancing lawyers we have instructed say we have to pay Land and Buildings Transaction Tax (Stamp duty in Scotland) on the full pre discounted amount rather than the actual discounted price. Is this correct? To clarify, we are receiving a cash discount rather than a deposit contribution.

Might it be worth changing your solicitor if you aren't confident in their advice? So much can go wrong with house purchases I wouldn't be comfortable using someone that I didn't trust with the basics

I know that doesn't answer your question, just seems you might want to be a little cautious

Yes, we are considering changing conveyancers. This lot were recommended by the builder and specialise in new builds so you'd think they'd know. My husband has since spoken to several colleagues who have received a staff discount and all paid LBTT on the lesser amount.

It depends on how it is discounted, is it completely discounted or are there additional incentives included? Ordinarily SDLT is paid on the purchase price as stated in the TR1/TP1 however with new builds the value of the incentives (fixtures & fittings etc.) are taken in to account. Would be worth clarifying this with your conveyancer.
