DS Under Investigation

Evening wise mumsnetters, just after advice please.

DS17 works in a high street restaurant PT, during an extremely busy weekend shift with limited staff, took just 5 minutes of their allocated 15 minutes break. They stupidly forgot to pay for what they had, as rushed back to help continue to serve. They remembered that evening and paid on their next shift.

This was apparently witnessed by one of the lower managers. Who has know put him up for investigation. DS is not supposed to know this and was made aware by other employees who had signed a contract. The investigation will invole reciepts for staff discount being used etc.

DS is distraught, has been employed here for over a year, in charge of many weekend closes etc.

Just wanted to know what his next steps would be?

Not to defend him in anyway for his mistake, however it has come to light that said lower manager is said to eat for free on mornings whilst DS not on shift, which is against policy, he was told this was the norm. Also when started was told X,Y,Z do not pay for drinks/food, also forbidden, two other managers freely help themselves. Along with staff working taking freebies before/during work.

I did question DS whether he had also taken advantage of others helping themselves, however his bank statements have proof of purchasing meals on shift which has a break.

I will also add that DS has been left to do things beyond his contract, and things which should be carried out by 18+. Also breaks restricted when entitled or no breaks at all.

He is really worried about the forthcoming meeting, which I assume will take place soon, due to rota being cut short, and missing shifts. Mainly due to the manager in question for the investigation will be present, who is a culprit himself.

Staff who warned him are concerned about looking into CCTV obviously as drops them in it, and want him go into the interview and put on the water works and it'll be fine. I'm guessing their telling him this to cover their own arse.

Any advice would be appreciated x

"Waterworks"? No. Unprofessional and unnecessary.

All he needs to do is say he forgot as it was busy, and show the proof of payment from when he remembered.

He definitely shouldn't point any fingers or get into any, "Well HE does this!" tot for tat shit.

Calm down, and tell him to too.

Firstly, having 30 years in hospitality I have never encountered one restaurant who expects staff to pay for meals on shift. There may be restrictions on what they can order ( no steak/ prawns etc) but meals are usually provided. So I’d tell him to go elsewhere for that alone.

He just needs to explain he rushed back and forgot to pay but did pay as soon as he remembered.

(I’d still encourage him to leave)

I advised waterworks was certainly unnecessary and not professional due to being a human error which was corrected, however was what was advised from employees, who seem to be worried.

He is pretty sure that he is being made the "scapegoat" in case they investigate into other staff, and to take it on the chin.

I am calm just annoyed at his situ, and after advice moving forward as he is less calm and worried.

I can't see they have a leg to stand on if he paid for it during his next shift.

It's a restaurant within a retail store. They do get discount, but I was shocked when found out they had to pay during a break, especially when they they started at 16.

I have encouraged him, and he is actively looking for other employment, this just fitted in well for college.
