Solicitor contacting the applicant of a non-molestation order

I was the applicant of a non-molestation order. The respondent's solicitor contacted me directly and asked for a copy of my statement, rather than request it from the court. This was quite intimidating. Are they allowed to do this please?

Are you represented by a solicitor?

Collaborate · 06/11/2023 17:40

The answer is yes, provided you aren't represented by a solicitor. How else are they to represent their client?

Coynetta · 06/11/2023 18:22

The civil procedures rule says that documents cannot be shared with anyone not connected to the case without the express permission of the courts and this solicitor had not provided the court with a notice to act in order to obtain the documentation directly from them.

But they aren't sharing the documents with anyone not connected to the case. Collaborate's answer is correct.

Coynetta · 06/11/2023 19:35

No, he was asking me as the victim to share the documents with him, but he was not formally representing his client in the case as he had not provided the court with a notice to act, which would be the correct procedure. I only know this because the court was very displeased by the Solicitors actions and said it could be deemed as intimidation and a deterrent to the applicant.

Why on earth are you asking then?

abouttobecomeagrandparent · 06/11/2023 20:31

Sorry no. I didn't keep a copy. That's all you need to say!

izzygirlis4 · 06/11/2023 20:35

Were they rude or nasty to you?

prh47bridge · 06/11/2023 22:49

By "the court", do you mean the judge or the court staff?
