Someone is renting out my garden!!!!

So long story short. We have recently found out that a neighbour is renting out their property with backs onto ours. Our garden ends in woodland. Unbeknownst to us they have fenced off part of our tree lined area and included it in the parcel of land they are renting out as their property. So they are renting out their house and their garden but including a chunk of our garden as part of the deal!! What should I do?! I’m fuming.

assuming you have all necessary copies of said deeds etc…. Instruct a solicitor to write to them instructing then to ensure the boundaries between the properties are correctly and legally reinstated forthwith as per the title deeds in order to avoid prohibitive legal consequences.

As PPs have said, either instruct solicitor or erect a clear border. Do you know them, and are they friendly? It could be a genuine mistake, or they're stupid. But you need to reclaim your land!

And then escalate if necessary. Your household insurance may include legal expenses insurance, which would likely cover the cost of a solicitor

I know you should go through a solicitor but I’m a hothead and I’d smash the fencing with a sledgehammer 😳 don’t take me advice.

I'd speak to them before engaging solicitor. Could be resolved much more cheaply and quickly!

Assume neighbours were living there themselves and only fenced off your land recently to rent it out, so they know it’s not theirs? Cheeky fuckers then?

I’d be taking the fencing down immediately and pacing it on their land. Tomorrow I’d be putting up some sort of blockade with a note through the door to tenants saying why and telling them it will be trespass if they enter your land. Tell them to inform their landlord that you will be taking legal action if boundary is breached again and follow up with letter to landlord with copy of deeds if you know owners address.

I would speak to them first (as it could be a misunderstanding) and as pp says cheaper and faster.

But if that didn't work then I would speak to a solicitor and seek legal remedy.

Send a polite letter first. If they refuse then go legal. If this goes to court it will help you to be able to show that you attempted to resolve this amicably and they they were the unreasonable ones.

Could the tenants have done this themselves? Wrote tot he owner and suggest there is a "misunderstanding" , you have removed the trespassing fence and trust they will remind tenants not to use it.

Write the owner and blame the tenants and ask that the fence on your property be removed immediately.

Go to the land registry first for copies of boundaries.
Once it’s been established it is your land approach them and give them a deadline to remove the fence and make it clear to their tenants they don’t have permission to use it.
If they don’t do this engage a solicitor.

Include photos of it and any plans so there is no doubt.

So it’s definitely our land on the deeds / land registry document. It’s not a mistake - they know it’s contested and they know it’s our land. There are currently no tenants in there so I was thinking of maybe informing the estate agent who is dealing with the rental. Surely they can’t allow something to be rented out if the garden on offer includes a piece of someone else’s land?! No- not the same poster who had a sail in my tree!

Oh and no- it wasn’t the tenants. It was the owner who is basically saying they’ve been using it so long that it is now theirs! It is very clearly ours if the deeds.
