Why do you need to update it? If you have it, you have it? At some point, you may decide you want to get a UK passport but that's a different issue and process.

ACynicalDad · 10/10/2023 17:15

You mean you didn't change it to your married name? I doubt there would be a problem.

Bromptotoo · 10/10/2023 18:18

Not an area I'm qualified to advise in but taking a common man's words approach...

Indefinite leave to remain, or Settled Status for EU folks, is, err, indefinite. Unless you embark on a life of crime it shouldn't change.

If in doubt have a quick word with an immigration adviser.

ILRHelpPlease · 10/10/2023 18:51

Yes, meant to change it if changing name on marriage. Can see a £1000 fine mentioned but have convinced myself I will get deported. I haven't done anything... other than stay in the country, work self employed and pay my taxes to HMRC so flying under the radar.

@Bromptotoo how do I find someone like that to talk to?

Have you changed your passport to your married name yet?

ILRHelpPlease · 10/10/2023 19:08

Yes I have a new passport, but took my embassy 2 years to sort out - hence me flapping about getting in trouble!

But ..... until you got your new passport there was no official change of name on your marraige as you would be crossing the border using your original name and paperwork.
So if you have just gotten the passport use that as the reason for the delay and that you are officially doing a change of name.

You can use the gov.uk site to locate and advisor.

@ILRHelpPlease the best thing in this circumstance is to complete the notification asap and include a note explaining how long it took to get your passport in your new name.

HicIocusEst · 11/10/2023 07:22

It should have been done within 3 months of your namechange, but you won't be deported, don't worry.
Contact them via the gov website asap.

RowenaEllis · 11/10/2023 07:24

The best thing would have been not to have changed your name - why would you make things so complicated for yourself?
Youre hardly going to be deported. Just do it now.

CatherinedeBourgh · 11/10/2023 07:25

When did your new passport come through? If it was recently, you can take that as your change of name and change it now. No big deal. You are not required to change your name the day you get married (or at all), so it's only once you change it on the official document that you need to do it.

AnotherNameNow · 11/10/2023 07:27

I had an old ILR visa (paper stamp) on my original passport with my maiden name. I got married, divorced, re-married (in a space of 15 years). So 2 name changes. Nothing on my ILR changed and no one ever blinked, I just presented it alongside my valid passport.

I have recently had to get the biometric ILR card. I just presented all of the relevant paperwork and had it issued in my married name. Again, no issues and just the processing fee.

You'll be fine

ILRHelpPlease · 11/10/2023 10:58

Oh my goodness, that sounds promising @AnotherNameNow

Thank you all. I can't tell you how this has stressed me out. Thanks for all the advice.

I think the fact that it's in your "old name" is very unlikely to be an issue. As long as you can prove that your old name is still your name so by taking along a marriage and/or birth certificate when travelling? DH has a European passport with a different spelling of his name - he travels with a document that explains that and it's not a problem (although a bit tedious).

go ahead and change it for convenience, but doesn't seem like a crisis to me. You are still you.
