Hi - to summarise I live in the top half of a house. Downstairs decided that they wanted to sell and in preparation for their home report they discovered a damp issue in their internal wall. They came to me asking for money to re grout the external wall so they could then complete internal works. I asked to see the survey and quotes. The survey indicates that the damp problem is being caused by a problem with the guttering. I told them I wanted to investigate that first and refused to pay for unnecessary work. We had a full survey done and as suspected, the guttering is causing the damp. In the interim they had all of the damp work done anyway. They're now demanding I pay for internal wall repairs as well, as one area of regrouting which has been done badly (according to survey). According to what I've read, I don't have to pay for any of their internal wall/ floor repairs which are generically on the invoice as a non guaranteed repair to ' penetrating damp'. Again, I did not agree to any of this work and it was carried out within two weeks of her first telling me about it. I did not see any written quotes.

The guttering still need to be fixed. They are now refusing to pay their half of the guttering repairs. I think I obviously need to get a lawyer but I thought that the Scottish Gov was quite clear about how to decide on repairs and the timescales for that to happen. I told them I wanted any work to be done after the full survey. Any advice much appreciated.
