Our neighbours recently had their garden levelled. Along our boundary line they didn’t create a retaining wall, instead building on top of the existing rubble etc. We have a shed there currently and have decided to remove it. We’re worried as their soil is only held in place by a part of the fence behind the shed and then there is nothing under that. Not at all sure why the fence doesn’t touch the floor?! (So a gap of just rocks in soil!) it is very slowly falling behind the shed. Where do we stand with this? We want to use the space to make into a patio area, but are worried if we start any works, or replace the fence when we move the shed, we could be blamed for their garden collapsing, despite it obviously not being made safe when it was completed. Where do we stand please?
