I am in a dispute with my neighbour over an obstruction on an easement across my land (the obstruction was there before I moved in). They have already sought legal advice and I am currently seeking my own however based on initial searches of the internet, this is not a case I would be willing to take to court and would concede before it got that far.

However, I would like to try and negotiate with my neighbour in the meantime to see if they would consider a compromise that everyone is happy with and to see if we can restore neighbourly relations.

My question is- at what point is the point of no return where I could potentially be liable to paying for their costs? Is it by the time it gets to court only or could I be liable before that. Essentially I am not prepared to take it that far and would rather concede before it gets near that point.

Why not just move the obstruction if you are going to concede anyway?
