Dad's "lost" insurance policy

My dad lost mental capacity some 6 years ago. He is in a care home. I have Deputy status (Court of Protection) and now look after all of his finances. Slightly before he lost his capacity, he handed me a folder with all of his financial documents (or so I thought).

Recently I received a letter addressed to him from an insurance company. It was an apology for not updating him about his health insurance policy (for the last 10 years!!!) Turns out that way back in 1999 he had bought a policy which insured against developing various health conditions, including cognitive impairment, for a substantial amount per year of care fees. I had no clue about this (there was nothing in his folder), and the insurance company had sent no communication before this "oops, we seem not to have sent you updates for a decade!" letter.

Obviously, I can now investigate claiming on his behalf. Does anyone think that I have a case for trying to backdate the claim 6 years, or is the responsibility for knowing that a policy exists rest entirely with the person who bought it, i.e. he should have told me? I'd like some suggested wording before contacting the insurance company if possible!

There was a lot of back-and-forth to prove my ID and his ID to prevent fraud, but it was sensitive and polite.

So pleased for you. And good to hear of an organisation going about things in the right way - well done Aviva. Makes a pleasant change.

Great work! There's a lot being done with insurance currently to make sure the policies are fair for the customer so they will definitely be keen to avoid explaining your material financial loss due to their lack of comms to the FCA...

Whew, the claim has been approved for future payments, which means that my dad's financial situation is now sorted for the foreseeable future. An incredible relief.

Waiting to hear separately about the backdated element of the claim, which would be the icing on the cake.

Wow that's great news! I so wish my Dad had bought something like this in the past. He passed away 13 years ago, leaving my mother in a great deal of financial stress and due to what he passed away from, he would've been covered.
I know they don't sell those policies anymore but I hope this is still a lesson to many who read this!

Thanks for all the good wishes! I'll update eventually (I always get annoyed when an OP asks for advice and then never comes back to the thread). I bought an annuity for my dad but not for the full amount of fees (hedging my bets!) and so his capital had been slowly running down. Now it is stabilised and should even start increasing a little.

Of course, had I known about the policy he wouldn't have needed such a large annuity, so I'll be glad if the backdated payment is approved (but being brutally honest that would mostly be about the inheritance he could eventually leave; I'm not expecting anything).

It's official, as of last week my dad's bank balance has stopped going down every month, and started going up a little.

Aviva are waiting for some more info from his GP before ruling on the backdated part of the claim. (I won't hold my breath, GP is overwhelmed.)

That's really good news, as a PP said, your Dad made a wise and well thought out decision when he took started that policy. I hope he lives the rest of his life in luxury with great care ♥️

After two months of chasing the GP surgery to send information, it's all been done... and Aviva have backdated the claim by 5 years! I need never worry about my dad's financial situation again and it more than pays for the annuities I took out on his behalf in the meantime. Wow.
