Looking for some advice. I cocked up the delivery address for an item (put 37 instead of 38) and it was returned to the seller. I have documentation that states it has been returned to sender. The sender (a large business) are refusing to refund me the cost of the item. I paid a £10 deliver fee on top of the price os the item which I recognise that I will not get back as I made the mistake, but the vendor now has the item and my money which they are refusing to refund!
They say this is covered by their term nd conditions. I belive that their T&Cs are not in line with legislation as under section 29 of the consumer rights act they have not come into my possession, as well the fact that I have paid for goods and they still have them. Can anyone advise me of my next steps?
I am bloody minded and prepared to take them to court about this despite it being a fairly low value item (under £100). I said I would ask for a credit card refund via my bank and they said they would fight it as they tried to deliver - which they did, but they 1) are not out of pocket for delivery as I paid the delivery charge and 2) they have the bloody item and will no doubt sell it again (it's not perishable).
Anyone any advice on what to do next?
