Is it possible to enforce an Irish court order in the UK?

Separated from my husband in 2014.

I live in Rep of Ireland, he lives in the UK.

I have a court order fo child maintenance that he's never paid.

Arrears are approx 66,000.

We also share a mortgage that he hasn't paid either.

I'm sinking in debt. Tonight I'm sleeping in my car outside of my house so it doesn't get clamped due to arrears on the fees we pay to the MGMT company. I was clamped on Sunday. I'm sleeping in my car so I at least have half a chance of hearing the clampers.

God I'm so sorry you are going through this. Sounds horrendous.

Go to the search bar at the top of this page and look for craicnet. You'll get more knowledgable (sp?) people on there.

Wishing you all the best.

Yes it will be possible. Your first port of call should be the court service in Dublin. They should have a reciprocal enforcement unit that can assist and guide you through the process.

I know this is cheeky, but could you move your car a distance away and ‘hide’ it? 😳

Marblessolveeverything · 21/06/2023 19:26

It was accessible under EU law previously. Was there an agreement post Brexit ?

You must hide your car, in a garage or driveway of a friends house. Sleeping in it won’t help it’ll just make you unwell. You need proper financial advice too. I’m a bit of an expert on U.K. benefits and legal stuff to do with debts but it’s likely not to be useful to you. I would imagine you’d need a U.K. court to issue an order but a cursory glance at the Gov page suggests that they have a system for entering foreign judgments to be enforceable in the U.K. so that should mean you can do it.

This is the information you need

www.gov.ie/en/policy-information/9985f-recovery-of-maintenance-from-abroad/

It's a very s l o o ow process, so perhaps contacting MABS might help your immediate crisis

Best of luck

I'm already with mabs. Thank you all for the advice and kind words.

I know there is a process to recover maintenance but you'd need a degree in law just to fill them out.
