Separation and Credit Card

Posted previously in the divorce thread but someone suggested I might get more response here:

It seems my husband and I are separating. We have a credit card where he is the main account holder and I have a card. I believe he is making high value purchases on it, but I am not able to view the statements. Is there anything I can do to stop him running up debt that I will be responsible for when we divorce?

I think you need to ask a solicitor but for now, cancel your card and make Sure you have your request to see statements in writing - also keep his responses. If it is not spent on items for the benefit of the family you will argue that it’s his debt and not shared.

@Mumof3confused so I should request from him the statements? The bank have said that as I am only an additional card holder thry can't share them with me.

@Waitingforsummer75 everything I've read online says that any assets or debt during marriage are "matrimonial" regardless of who's name they are in.

The card account is in his name, so you won't be responsible for his debt.

I'd watch out for him using joint savings to pay it off though.

It won't be your debt. He will have to declare it as part of his financial disclosure, and it will reduce the size of the pot to be shared between you. However, if he is spending recklessly the courts can take that into account in determining the financial settlement.
