Neighbours downpipe draining onto my garden

Hi, I needed some advice on how
best to approach this issue, whereby neighbour has just built his extension however rather than create a soakway and have surface water running to it, he has decided to leave it on the edge of the property going into the ground.

The issue with this is my property is around a foot lower than his (his is on higher ground) and so all the water is now pooling on my driveway next to my property :-s

I was going to contact building control to ask them to look into this, but was concerned would this be treated as a dispute if I was to sell my property?

I do have a party wall act in place so wasn't sure what's the best mechanism to get this addressed sooner rather than have problems later.....Unfortunately not on talking terms with neighbour due to invoking party wall and they getting particularly irate when I was taking pictures when they built the flank wall (as surveyors suggested).

Do you have contact details of the party wall surveyor?

I think I’d start there, as this is exactly the type of issue that the party wall arrangements should cover.

Yes I do and will contact them, this isn't classified as a dispute is it?

I hate this feeling of where you feel reluctant/scared of saying anything as you don't want to create future problems for yourself when selling but at the same time don't want to turn a blind eye on something that could cause damage to your property....

I don't see why it should be classed as a dispute. You phone and ask the question - no reason for your neighbour to know unless things escalate further. But did he say why he didn't have a soakaway or a gulley for water to run away avoiding your property?

It isn't a dispute, you are raising a legitimate concern that needs addressing.

This. There absolutely should have been drainage in the plans, as we had. Surprised if building control would pass it and issue the certificate without.

No we haven't spoken, I did mention to his builders workers that the downpipe shouldn't be left like that to which he agreed.....but it's now been 3 weeks and no further work on it has been undertaken by the cowboy builders....ie the building work has been done on the cheap which I can understand
in the current climate as long as it doesn't impact our property.

Well, if it is ever listed as a kind of dispute, any subsequent buyer of your house ought to be glad you raised it and got it fixed.
