Need advice please

Hi I am looking for some advice I was made "redundant " In May. I got a phone call the day before wages where due that the business was going into administration and that I would be contacted by someone to hopefully get wages back etc. Fast forward 4 days after this the owner announces that 2 stores will be opening back up.

I asked can I come back and was told no as part of the terms was only 2 stores allowed to open with one member of staff in each and herself to split the week between the two.

So now I don't really no where I stand ? The company is still listed as active on company house. She's ignoring my messages. How do I go about get my last months wages ?

I tried Citizen's advice and was no use as I don't have an office near me.

If anyone could give me some advice on what my next steps should be?

How long have you been employed for?

All the information about redundancy is here www.gov.uk/redundancy-your-rights

If you had more than 2 years service you will be entitled to redundancy pay and if the company can't pay it there is a government service to claim it. Even without 2 years service you should be entitled to notice or pay 8n lieu of notice.

If they don't pay you your wages (including redundancy pay and anything else to which you were entitled such as holiday pay), you can make an Employment Tribunal claim.

Been there just 2 months shy of 2 years . So I didn't think I would get redundancy I just want my last months wages.

No, you won't get redundancy, but you are entitled to your final wages including any holiday pay they owe you. Of course, they can also deduct any holiday pay you owe them. If they don't pay, the Employment Tribunal is your friend.

You used to be able to bring an employment tribunal claim if you were made redundant but your job/job title was still existing - after you were made redundant.

I think but unsure she can due ET as well as if she gets wages because they’re opening two more stores, but with members of staff working there. I suppose they could argue she’s not needed for business needs.

There is too much focus on redundancy here. As OP hasn't been there for two years, she can't claim unfair dismissal or redundancy pay, so she has no claims related to the redundancy as such. The only thing she can claim is her unpaid wages.

OP isn't entitled to statuatory redundancy pay due to length in service but is still entitled to the correct redundancy process being followed and that means

  • at least 1 weeks notice or whatever is in her contract with the most beneficial term to the employee being adhered to. Either to be worked or paid in lieu
  • salary owed
  • annual leave owed

These are covered under redundancy rights and are a legal requirement.

Hi yes the redundancy part doesn't bother me its more the giving no notice and no wages.

Citizens advice is no use here I can't even speak to someone on the phone.

Will give acas a phone.

There is a national telephone advice phone number.

You're not going to get through to individual offices because they are understaffed.
