Letters of Administration vs Probate

I applied for probate for a relative late last year. There was a Will but it was quite old so one of the executors has passed away and one is too unwell to assist.

As part of the process the ill executor signed a PA11 form making me and and the deceased’s spouse the attorneys for the will so we could administer on their behalf.

Today I have received ‘Letters of Administration with Will’ in the post. Can we now administer the will? Or will we also be getting a separate grant of probate that we need to wait for? I have googled and googled but can’t find a clear answer anywhere.

In case it makes a difference, all assets will pass to the surviving spouse and the estate value is under £1m but the deceased had assets in their sole name of around £50k so we were advised we needed to apply for probate (by one of the financial organisations who hold some of the funds).

Yes, you can now administer the will. As you are not a named executor, you get letters of administration rather than a grant of probate.

That’s great news, thank you. We’ve already been waiting for 8 months so I was concerned it was going to drag on even longer!

They could also refuse if the child is serving a detention, but otherwise I agree with the previous poster.
