A client commissions an artwork from a designer. Artwork is then picked up to be featured in TV broadcast and print publications.
Comes to the designers attention that client has presented as designing the artwork themselves in the print publication.
Have addressed the print publication for correction for the designer to be credited for the work. Awaiting feedback.
In the case of the tv broadcast, we don’t know if the client has presented as designing it. It may just be a factual this is the art work and I am the owner which would be fine. If representing as designing it then obviously not going to be happy about that as makes designers company look potentially fraudulent to future customers as claiming they have designed it when tv says differently.
Initially did not assume designer would be credited on tv broadcast as rules to advertising companies. However now wondering if that is a myth/ was a naive assumption.
Without getting legal is their ways to tactfully address this with tv? If we start getting legal with letters and lawyers etc we probably have to inform our insurance who cover us for copyright and IP. This is already a can of worms and this is headache enough to deal with, without opening additional cans ourselves.
Anyone to shed any light?
