Child maintenance payments for child with learning disability

Hi Everyone

My son has Autism and dyspraxia. He is just about to finish college and his father has told me that he is stopping his payments now. I have told him that our son wants to and has applied to continue his education at degree level, which, considering the mountain he has had to climb is completely amazing. My ex still won't pay but I need that money to keep a roof over my sons head and support him through his degree. Does anyone know if there are any specific rules on this?

The rules are that maintenance ends when the child is 16 or finishes full time secondary education. You may be able to get a court order for continued support under Schedule 1 of the Children Act 1989 provided you apply before your son's 18th birthday. Alternatively, it may be possible for your son to apply for an order himself. See a solicitor.

Remember that, even if you don't get any child maintenance, your son will be entitled to a maintenance loan even if he is living at home. He may also be entitled to Disabled Students' Allowance, which does not have to be paid back.
