Simple power of attorney- who can witness

I need my brother to grant me a simple POA so I can extend the lease on a flat for which we are tenants in common. He is currently in a mental health rehab facility but does have capacity. We are meeting up tomorrow. Could my husband be a witness ( he has no ownership of this flat). Brother is quite private and I don’t think he’d like any of the staff at the facility to be witnesses. Thank you for any information.

Thank you I have tried googling but all the info out there is about lasting power of attorney, not simple POA for a single transaction.

Any adult over 18 who is not blind is the legal answer. However I personally would not use a relative as it looks less
dodgy if something goes amiss. The witness doesn’t have to be able to read the doc, just witness you signing it.
