neighbour stand off

Hi, someone has advised me to post here for some advice. A few years ago my husband put up a fence inbetween us and the neighbours. My husband got all of the fencing for nothing and went so far as to get him all the fencing required for his side of the fence to. The neightbour was happy to have the posts on his side as he was putting up fencing and said he was going to plant something. Anyway. he filled up some raises beds and filled them with soil and planted bushes so he'd have privacy. These bushes are tipping my fence over, I had someone come for a look and the posts are rotten along where he's planted the bushes with all of the soil. He told me the other day there's no way he's taking his bushes out, he said he will come and put posts in my side of the garden to try and straighten the fence up. He said himelf a few months ago he shouldn't have piled all that soil in but is now denying he said that. My garden is rubbish as it is, infact looking on the deeds he has some of my garden. My garden isn't massive and I really don't want posts on my side as it will look pretty rubbish. Does anyone have an idea of how to go about dealing with this.

Go out in the dead of night and pour plant killer into the bushes. Kill them off.

What a ludicrous answer, yes resort to criminal activity .

the posts should not have rotted normally. The posts should have been put in a hole filled with gravel, so no dirt came near it, then filled with cement. As such they then don’t rot. However are you saying he’s put raised beds in and the dirt is above ground level and in contact with the full fence, as such all of the fence has rotted not just the posts?

@Frankieisbackfromhollywood Hi, so sorry I didn't see this till now. Having a bad day with a poorly doogy. Yes the fence was up for a good year or so when he then put in the raised beds and filled them with soil and these bushes. The posts have rotted and my garden fence is sagging. Since my husband left he seems to think he can get away with shouting that he's doing nothing and I need three new posts along my side of the garden. Surely though it's going to carry on happening. I I have a much smaller garden as I'm right on the corner. My husband got all of the fencing and we have always been friends with our neighbours, so my husband did all of our side and got the neighbour all the fencing for the rest of his side for nothing. The neighbour told my husband he didn't mind having the posts in his side as he was fencing it anyway. I don't have money for a solicitor and he's just being nasty with me as he knows I won't stand up to him. Thank you for replying, it really is appreciated.

@Mollylegs if the neighbour has put ANYTHING on your land you need to see him off now. I'd have one last word with him that you want his property off your land by X date (give him 28 days) or you'll instruct a solicitor. His land grab attempt is not friendly so you don't treat him like a friend.

This isn't about a fence anymore. He is stealing from you.

Get a copy of your land records from Land Registry, establish the actual boundary and how far he has encroached and then pay a solicitor to send them a letter telling them to move back or you'll proceed to court and will be claiming all costs in addition to damages to put your land back to rights.

It may be enough to scare the cheeky sod off.

@FartSock5000 Hi, it's not exactly a funny matter but thank you for firstly your name and secondly your fab attitude. He has lay a patio and built a garage over some of my property. Someone had said the time had probably lapsed that I could have done something about it. Don't get me wrong, it's not a massive amount of land, there is a fence that was meant to come at a sraight point from the bottom of the garden but he told my husband when the old lady lived here before us he repaired the fence and took what he wanted. It was a council property that we moved into 15 years ago and we have been friends witht the neighbours since. My husband bought the property 6 years ago and he left me 7 months or so ago, the neighbour has always been a kind of a bully but the kind who would bully a woman, he wouldn't dream of saying anything to my husband. When I asked him the other day he just mouthed off at me, said he would put three new posts in my side of the garden but i don't think it will solve the problem.
