Lease Agreement Termination

Lifehaslifedme · 06/05/2023 00:04

DD22 months has been diagnosed with Leukaemia.

We live in a 2 bed apartment rented through an agency. It runs yearly and has no break clause.

I have to resign to look after her.We can't afford the rent on DHs salary therefore must downsize.

Any advice on how to get out of it?

First write to the agency and ask if the landlord will consider a reduction. I would.

Have you looked to see if you can claim UC or have you applied for DLA for your dd? if you claim DLA & get awarded middle rate care, you can claim carers allowance, it may be that dd has to have been poorly for 3 months, ring up to find out.

Thank you all for the replies.I will do as advised.UC will not kick in straight away which leaves us struggling.
Landlord relies on the money as it is her pension.

Check any insurance you have. Do you have critical injury cover? See if it will cover giving up work to look after your daughter. Sending lots of love to you all x

Sorry to hear you're in this situation.

I once needed to get out of a lease early due to a relationship breakdown, I explained to the landlord and he let me give 2 months notice rather than remain liable for the remaining term of around 9 months.

It's obviously a huge shock to you just now but don't make any hasty decisions, there might be a way forward. But definitely speak to the landlord asap to explain, especially if you're not going to be able to pay v soon.

Sorry you are going through this. Worth trying but the rental market is crazy with rents being hugely lifted due to the current inflationary pressures, but more so by the governments tax hits on private landlords.
What they might do is what you want and accept early termination rather than risk being sat with a tenant that can't pay the rent and with a court probably being a little sympathetic due to your circumstances

I have the Landlord's number and could ring and talk to them.I am worried about overriding the agency though. Wouldn't that cause problems?

So much to think of ..my head hurts.

A bit question here is where will you go if you move out? If you don't have anywhere to go, by leaving voluntarily you're making yourself homeless and you won't get any council help.

We are downsizing to a one bed for now.
