Advice about Distance Sale Returning Car

I need some advice on what to do next please.

I purchased a car online via distance sale and want to return it. I know i'm within my rights to return it for a full refund within 14 days etc.

I've told the dealer that I am going to return it and he's told me that he's not accepting it.

I've already booked for the car to be picked up this week to take it back to the dealership. Should I go ahead and return it anyway without him agreeing?

Refer the dealer to www.themotorombudsman.org/distance-sales-faqs

Make it clear to the dealer that you are returning the car this week and, if they refuse to accept it and provide a full refund, you will take legal action including claiming the costs you have incurred due to them refusing to accept delivery.

You can make a money claim online up to £100k and the process is very easy if they won’t play ball. Make sure you get the delivery company to get the vehicle signed for at the dealership when it is returned. They certainly sound like chancers and cannot avoid the law. Read this article below because without the correct paperwork you actually have up to one calendar year and 14 days to return it, even if you have used it. Obviously this loophole was exploited by someone in the know, but the principle still stands.

DSS ordered a car online and it was a disaster. He's out of pocket, but not massively. But hassle!

I will never order a car online again unless it's brand new. Too much stress.

Thank you for this, Yes I've told him to get signature and photos on delivery.

This article has opened my eyes even more. He never even told me about my rights to cancel within 14 days. I actually have a full 12 months😮 I was still trying to be as reasonable as possible by even agreeing to pay for return when I don't even have to!
