Photo taken for traffic offence

we were pulled over today (no reason just random) and it transpired we’d inadvertently committed a traffic offence. Complete oversight (think MOT expired without realising - not that but similar genuine mistake) and immediately put hands out and admitted it was our mistake when it was pointed out (was hithero totally unaware). All ok and quite friendly but police officer took a photo of DP before reading rights.

Just wondered if anyone knows the purpose of the photo? It was quite informal, by roadside side on etc so not a mug shot. I’ve googled but not managed to find out why they need a photo. Tia

Presumably so they can identify your DH if he later claimed to have not been driving the car/ the car had been cloned etc

I would imagine for evidence your DH was there at the time and date they said they pulled him over in case he later challenged it

If your car shows up on anpr then it’s not pulled for no reason

photo means he can’t deny having been the driver if things progress

Ok thanks. No we were pulled over for no reason. It was pure chance that there was an issue and in a way we were pleased (despite fine and points that are inevitably coming) as we’re now aware and not driving illegally as we were not aware of the issue and now we are!

They said it was for no reason and can’t see why they would have lied. They were randomly stopping vehicles and when they checked it showed an issue

If your TAX or insurance had expired thats why you were pulled over, your car would have shown on ANPR as having what ever the big secret is, missing

You don't just get pulled over for no reason

Most offences are fine and points, if you aren't insured they can stop you driving your car there and then, I doubt there will be any prosecution unless it was really bad stuff.

The police aren't stupid

Of course they would have known that your car didn't have an mot. They probably wanted to see who was driving first and from your reactions they could then work out if you genuinely didn't know the mot had expired or not and this would then help them decide how to proceed

Was it an expired driver's license? I got pulled over as one of my back lights had been broken. Must have happened in a car park and I hadn't noticed it. They pulled me over to tell me, and they wanted to see my license, probably incase the car was reprtted as stolen or involved in amy accidents later on. He saw it was expired but just told me to renew it; said it could have been a £1000 fine but that he wasnt going to do anything about it. Just let me go and that was it. You dont even need to carry your license with you so if I'd have known then I'd have just said it was off for renewal and posted it the next day but I didnt realise it was expired!

Nope, they said they could seize the vehicle but wouldn’t as it was an honest mistake so we had it collected (agreed with police)

In that case that was why they stopped you. It wasn't just a random stop. If your car doesn't have tax/ins or MOT it'll flag up on ANPR in their car.

Any of those missing is a reason to have the car siezed.

It wasn't that the car was insured in your name and DH was driving and had been forgotten to be put on the insurance or something like that then they would need a photo as you could have been perfectly legally driving the car yourself and could say that at a later date. Also then it would be totally random that you were stopped and they wouldn't know until they checked who was driving and who had insurance

It was tax as when we bought it we were told it was taxed but the law changed in 2014(!) and now tax is with the owner not the vehicle. Hadn’t bought a car since then so hadn’t realised. No big secret just didn’t want a debate about how stupid we were for not checking as I’m fully aware of that! I was just curious about the photo.

Oh no, so yes it would have been random as the car was taxed but with the wrong person, did you buy it privately as garages usually sort it for you. Maybe the photo is because someone else has the tax, you may not get points for that, just a fine

You would of had tax reminders as the registered owner.
Insurance can also be invalid with no Mot.

The police car ANPR would of picked up the no MOT. And pulled you over

So what happens in the case of a family car? Car in person a's name, has tax, person a and person b (husband and wife) both fully comp insured on car. Take turns driving. What happens if the one who sorted the tax isn't driving?

The registered owner taxes the car, person B is the named driver

We don't know how long OP had the car, a tax reminder comes when it runs out or the registration document getting sent off will flag it, though doesn't DVLA get that so it could take several weeks to come to light as they aren't the quickest
