Arnold Clark Cyber Hack

I've had an email saying my personal data was compromised in the data hack last month. This includes, name, dob, national insurance number, copy of my driving licence and bank details, basically everything used for the finance proposal.

They have advised Experian will monitor my credit report for fraud for the next 2 years.

I spoke to my dad about this and he said to contact one of those no win no fee law firm and take this further.

Do I have grounds for this?

I dont see what you'd be claiming for as you haven't suffered any loss

I doubt it unless it could be proven they failed to take all necessary steps to protect the data. Especially if you've experienced no loss.

As sensitive personal data has been leaked, you may have a claim for compensation, but data breach cases are not straightforward. However, those posters who think you can only claim if you have suffered a loss are wrong. You can claim for non-material damage, including distress.

I understand the cyber criminals involved have threatened to share all the data on the dark web unless Arnold Clark pay a multi-million-pound ransom. If reports of the types of data stolen are accurate, this puts affected customers at serious risk of being the victims of identity theft and being targeted by phishing scams.

It will help claimants if ICO decide that Arnold Clark are at fault, but ICO don't award compensation. Victims don't have to wait for the ICO investigation to conclude before lodging claims.

The direct answer to your question is yes, you may have grounds for a claim. A number of solicitors who work in this area of law appear to be putting together group claims. If you want to pursue this, you may want to contact one of them.

I'm certainly worried about the possible, although hopefully minimal, risk of my information being sold. I have also seen that they are selling it on the dark web for a ransom and I can't see if AC are willing to pay the ransom, and at what guarantee the information hasn't already been cloned by the hackers..

Hi I’ve had one of these emails as well and I am worried about my details being given out and the implications of this. I have asked Arnold Clark to confirm if they know for definite if my details have been taken or not.

Hi I also received the email and have since had attempts for numerous payments on my account totalling around £3k since 14th Feb. Now had to cancel bank cards and have them reissued.
I've also had numerous telephone calls claiming to be my bank to obtain details 😔
