Hi, Can I have some advice please.
Money claim online done and was road to add any trading names of the business so I did.... .mr Joe blogs t/a blogs repairs.
Fast forward to beginning of march had final hearing which defendant didn't turn up (didn't turn up for anything throuought or engage apart from respond to initial claim notification online).
I was awarded a judgement where judge said this will impact him financially such as credit etc.... and he has 14days to pay when he gets the letter.
Both received the letter says I'm awarded the sum of £xxxx. The letter has at the top me and Joe blogs t/a blogs repairs. In the boxes to the right says me as claimant and defendant as Mr Joe blogs.
Hes told me he'll pay 50 a month on the 1st and not received it today and he's said he's closing the business.
I've told him that it's irrelevant closing the business as sole trader not limited company so debt will still be owing and that I will take further.
He said there's no ccj against him as he's checked his credit file. He also said any judgement or ccj will be against blogs repairs and not him.
Here's my questions.
Who's right about the name ?
Why wasn't the judgement a ccj but instead a judgement order?

Thanks.

That is a CCJ and it is against him personally.

This is why I like Mumsnet.
That simple answer above would likely cost £100+ to ask a solicitor in real life.

Thank you.
Why isn't it registered? Is the court behind with admin or is it simply another form of a ccj?
I'm worried that as its not on his credit score that he won't see the implications that it'll cause

You only have his word that it isn't registered. Given his behaviour, are you sure you believe him? It sounds like you are going to have to go back to court for enforcement.

CCJ "county court judgement" is exactly what this is.

He has one calendar month before the CCJ will appear on his file. If it's within a month then that will be why it isn't appearing for him yet. If it's over one calendar month then he is either lying or the court is astronomically behind on their judges orders which doesn't usually happen. Our court posts files to other allocated courts if we get more than a week behind.

You can go back to court to enforce it and try to get your money back, but if he lives on the breadline you may not ever see any of it. If he is employed, you can ask the court for an attachment of earnings so it gets taken automatically from his salary by his employer.

Hi, I paid £8 through the government website to search TrustOnline. My judgement did not show.
I used his name and address used for the court.

It wont have been automatically registered by the court as it isn't a default judgment but one that was given following a hearing.

It should have been registered as the Defendant didn't attend - you will need to call/email the court to query the registration status and they can register it if it was missed when the order was drawn.
